This is the true story of John Leonard — a 21-year-old business student with no money, no airplane, and no way to fly one — who read a Pepsi commercial as literally as a corporate lawyer, found a mathematical hole in it worth tens of millions of dollars, and mailed PepsiCo a check demanding a military fighter jet.
In 1995, losing the cola war to Coke, Pepsi launched Pepsi Stuff — collect points off bottle caps, redeem them for merchandise in a 64-page catalog. The centerpiece was a prime-time TV commercial: a teenager lands a $33 million AV-8B Harrier jump jet at his high school, with the on-screen text "Harrier Jet — 7,000,000 Pepsi Points." It was a joke. No asterisk, no disclaimer, no fine print. Every executive at Pepsi and its ad agency signed off without a second thought.
Then a student in Seattle actually did the math.
The catalog contained one line nobody at Pepsi's billion-dollar marketing department had thought through: Pepsi Points could be purchased outright for ten cents each. Seven million points, then, didn't require drinking an ocean of soda. They required a check. Ten cents times seven million points came to $700,000 — for an aircraft the Marine Corps valued at roughly $33 million.
On March 28, 1996, PepsiCo's mailroom opened an envelope containing a cashier's check for $700,008.50, a Pepsi Stuff order form with fifteen points along the top, and one line written by hand: "1 Harrier Jet." By every word of Pepsi's own published catalog, a 21-year-old had just legally ordered a military attack aircraft.
Pepsi refused, then filed a federal lawsuit to make him go away — spending some $2 million in legal fees against a student who spent almost nothing. In court, PepsiCo's own attorneys were forced to argue, in writing, that their own commercial was obviously a joke that no reasonable person could take seriously.
In 1999 a Manhattan judge ruled — and the decision reshaped how every fantastical advertisement on American television has been written for the thirty years since.
This is the full story of the Harrier jet, the ten-cents-a-point loophole, the $700,000 check, and the business student who took the largest beverage corporation in America to federal court over a soda commercial.
